Privacy Policy

Last updated: October 2026

Breathe Psychiatric Wellness, PLLC (“Breathe,” “we,” “us”) respects your privacy. This policy explains how this website handles information. It applies to this website only.

Patient information is handled separately

If you become a patient, the health information you share with us is protected under federal privacy law (HIPAA) and Arizona law. Our full Notice of Privacy Practices is posted below on this page. You can also ask us for a paper copy at any time.

What this website collects

This website does not ask you to enter health information, and it does not have a contact form. If you call or email us, we receive the information you choose to share, such as your name and phone number. Our website host, Wix, automatically collects basic technical information such as browser type, device, pages viewed and general location, using cookies and similar technologies. This helps run, secure and measure use of the site.

Booking appointments: "Book a free call" buttons take you to our scheduling page, hosted by IntakeQ, a separate secure patient platform. Information you enter there is governed by IntakeQ's privacy policy and our Notice of Privacy Practices, not this website policy. Blue Cross Blue Shield of Arizona members book through Headway, a separate platform with its own privacy policy.

Email: Regular email is not a secure way to send health details. Please don't include personal health information in emails to us. We will cover it privately at your visit. Calls and texts to (480) 637-4174 go through Spruce Health, a secure communication service built for healthcare.

How we use information: We use information to respond to you, schedule care, and operate and improve this website. We do not sell your personal information, and this website does not use advertising or social-media tracking pixels. We use trusted service providers to host this website (Wix), manage cookie consent (Usercentrics), and schedule and support care (IntakeQ, Headway, Alma and Spruce Health). To ask what information you've sent us through this website, or to ask us to delete it, contact us using the details below.

Cookies: When you first visit, a banner lets you accept or decline non-essential cookies, and you can change your choice anytime using the cookie settings link. Essential cookies keep the site working. You can also block or delete cookies in your browser settings; some parts of the site may not work as intended without them.

Children and teens: We see patients ages 12 and up. For patients under 18, a parent or guardian should contact us and complete scheduling. This website does not knowingly collect personal information online from children under 13.

Contact us: Breathe Psychiatric Wellness, PLLC. Phone (480) 637-4174. Email admin@breathepsychiatry.com.

Changes: We may update this policy. The date above shows the latest version.

NOTICE OF PRIVACY PRACTICES

This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.

Effective date: October 2026. Breathe Psychiatric Wellness, PLLC ("Breathe") is required by law to protect the privacy of your health information, give you this notice of our legal duties and privacy practices, follow the notice currently in effect, and notify you if a breach affects your unsecured health information.

Our Privacy Officer: Frances Hall, PMHNP-BC. Phone (480) 637-4174. Email admin@breathepsychiatry.com.

How we may use and share your health information

Treatment: to provide and coordinate your care, for example sending a prescription to your pharmacy or talking with another clinician who treats you.

Payment: to bill and get paid by you, your health plan or a platform that bills for us (such as Headway or Alma), for example confirming your coverage.

Health care operations: to run the practice, improve care and train, for example reviewing our records or using secure scheduling, messaging and billing vendors that sign business associate agreements with us.

Other uses allowed or required by law: when required by law; for public health and safety, including to prevent a serious and imminent threat to you or others; to report suspected abuse or neglect; for health oversight (such as licensing boards); in response to a court order or valid legal process; to law enforcement as the law allows; to coroners; for workers' compensation; for specialized government functions; and to check the Arizona Controlled Substances Prescription Monitoring Program when prescribing controlled medications.

Family and others involved in your care: we may share information with a person you identify, or with a parent or guardian of a minor as Arizona law allows, unless you object when you are able to.

Uses that need your written permission: most sharing of psychotherapy notes, marketing, and any sale of your information. Any other use not described here needs your written authorization. You may revoke an authorization in writing at any time, except where we already relied on it.

Substance use disorder records: if we receive records protected by federal law (42 CFR Part 2), we will not use or share them in legal proceedings against you without your written consent or a court order.

Arizona law: Arizona law (including A.R.S. 36-509 and 12-2292) gives mental health records extra protection. When Arizona law is stricter than HIPAA, we follow Arizona law.

Your rights

See or get a copy of your records: ask in writing. We respond within 30 days and may charge a reasonable, cost-based fee for copies.

Ask us to correct your records: ask in writing if you think something is wrong or missing. We may say no, and will tell you why in writing.

Ask for confidential communications: for example, to contact you only at a certain phone number. We will agree to reasonable requests.

Ask us to limit what we use or share: we are not required to agree, except that if you pay for a service in full out of pocket, you may ask us not to share it with your health plan, and we will agree unless the law requires otherwise.

Get a list of disclosures: ask for a list of times we shared your information in the past six years, other than for treatment, payment, operations and a few other cases. One list a year is free.

Get a copy of this notice: on paper at any time, even if you agreed to receive it electronically.

Choose someone to act for you: a legal guardian or medical power of attorney may exercise your rights.

File a complaint: contact our Privacy Officer above, or file with the U.S. Department of Health and Human Services Office for Civil Rights at www.hhs.gov/ocr/complaints or 1-800-368-1019. We will not retaliate against you for filing a complaint.

Changes to this notice: We may change this notice, and changes will apply to all information we have. The new notice will be posted on this page and available on request.
